Cashback Terms & Conditions
I. GENERAL PROVISIONS
1. The present regulations specify the terms and conditions of participation in the
CASHBACK programme (hereinafter also referred to as: ,,Programme"/"Cashback
Programme"), organised by AleRabat.com sp. z o. o. with its registered office in
Katowice (40-611) at ul. Fabryczna 24, entered in the Register of Entrepreneurs of
the National Court Register kept by the District Court Katowice-Wschód in
Katowice, VIII Economic Department of the National Court Register under the KRS
number 0000570132, amount of the share capital PLN 30,000.00 (paid in full), NIP:
9542757135, REGON: 362184710, e-mail: [email protected] (hereinafter
referred to as:
, "Organiser").
2. In all matters not regulated in these Terms and Conditions, the rules and
regulations of Alerabat.com available on the Website shall apply. In the event that
for a given country the Organiser makes available other products in which it enables
the use of the Programme, including in
in particular such as an Application, a Plug-in, other software or other infrastructure,
such Regulations may also be available at these locations.
3. Participation in the Programme is voluntary.
4. The programme is only addressed to non-business individuals. The
programme is not aimed at entrepreneurs.
5. The Programme is a bonus sale and enables its Participants to receive a
certain number of Cashback Points in connection with an order from a
Partner of a product or service indicated in the Cashback Promotion
(hereinafter referred to as:
, "Purchase") or in connection with Successful Participation in the Refer & Earn
Programme. Cashback Points may then be redeemed for a Reward, subject to the
terms and conditions set out in these Terms and Conditions.
6. The provisions of the Act of 18 July 2002 on the provision of services by electronic
means (Journal of Laws of 2002, No. 144, item 1204, as amended) shall apply to the
services provided by the Organiser under the Programme.
7. The public nature of the Internet and the use of services provided electronically
may involve the risk of Participants' data being obtained and modified by
unauthorised persons, so Participants should use appropriate technical measures
to minimise the aforementioned risks and, in particular, use anti-virus and identity
protection software to protect the identity of those using the Internet.
II. DEFINITIONS
Capitalised terms used in the Regulations shall mean:
1. Regulations - this document;
2. Website/Service - the website available in the domain alerabat.com, owned
and administered by the Organiser, where the Cashback Programme is made
available to the Participant;
3. Alerabat.com - the collective term for the Website, Application, Plug-in and other
software or other infrastructure made available by the Organiser, where in a
country the Organiser allows Participants to participate in the Cashback
Programme using such software - as indicated on the Website and in such
product. Where the Organiser does not make a product available in the country of
the relevant Participant, references to such product shall not apply to that
Participant;
4. Participant - an adult with full legal capacity who is a user of Alerabat.com and
who participates in the Cashback Programme under the terms of these Terms
and Conditions;
5. Consumer - a Participant who is a consumer within the meaning of Article
221 of the Civil Code, i.e. a natural person making a legal transaction with an
entrepreneur
not directly related to its commercial or professional activities;
6. Invited Person - a person invited by a Participant to participate in the Refer and
Earn Programme,
7. Points/Cashback Points - points received by the Participant under the
Programme. Points may also be denoted by the Participant's currency;
8. Organiser's Partner/Partner - an entity or person indicated on Alerabat.com,
being a business independent of the Organiser, with whom a Purchase entitles
the Participant to receive Cashback Points, under the terms and conditions set
out in these Terms and Conditions;
9. Refer and Earn Programme - a referral programme aimed at Participants,
10. Promotion/Cashback Promotion (also referred to in plural as:
Promotions/Cashback Promotions) - promotional or similar content presented on
Alerabat.com providing information about the possibility for the Participant to receive
Cashback Points in exchange for the Participant purchasing certain goods or
services directly from the Affiliate indicated in such
Promotions;
11. Prize - a prize linked to a bonus sale organised by the Organiser and
provided in the form of cash available to the Participant in exchange for
accumulated Cashback Points
III. GENERAL RULES FOR PARTICIPATION IN THE PROGRAMME, CASHBACK ACCOUNT
Participation in the Programme is free of charge for the Participant and is possible
provided that the ICT system used by the Participant meets the following minimum
technical requirements:
1. When using the Programme on the Service:
1) a computer or mobile device with Internet access,
2) access to e-mail,
3) the latest version of your browser with JavaScript and Cookies enabled,
4) a programme for reading PDF files;
2. If you use the Programme in other products made available by the Organiser,
such as the Application, the Plug-in or other types of software or infrastructures
(where in your country such products are made available):
1) correct installation on a compatible device, system or similar, as indicated on
Alerabat.com and where it is made available;
2) Internet access;
3) access to e-mail;
4) an active and correctly configured on the device, system or similar data
service made available by the telecommunications operator or a wireless
connection in operation.
3. An individual who meets all of the following conditions may be a
participant in the Programme:
1) is over 18 years of age and has full legal capacity,
2) is a Consumer,
3) there are no legal or factual obstacles to its participation in the Programme.
4. In order to participate in the Programme, the Participant must register an
Account with Alerabat.com and read and accept these Terms and
Conditions.
5. A Participant can only take part in the Programme once at any one time, which
means that each Participant, using his/her name and surname, with an indicated
bank account number, is entitled to have one account with Alerabat.com, in which
Cashback Points will be credited. The Organiser has the right to verify whether a
Participant has more than one account, including the right to request an explanation
from the Participant. In the event that the Organiser has a reasonable suspicion that
a Participant has
more than one account on Alerabat.com, the Organiser shall be entitled to apply the
provisions of Chapter VII of the Terms and Conditions accordingly, and in particular to
terminate the contract on the basis of the provision of Chapter VII, section 3,
paragraph 1.
The provisions of Chapter VIII of the Terms and Conditions shall apply accordingly.
Unless otherwise indicated, in Alerabat.com for the country where the Organiser
makes its products available, a Participant who has registered a Cashback Account
using the Website or another Alerabat.com product may log in to his/her Account on
another Alerabat.com product using the same login details.
6. Unless otherwise indicated, the Participant joins the Programme as
soon as the Participant has successfully registered an Account with
Alerabat.com.
7. In particular, each Participant is obliged to:
1) not to provide or transmit content which is prohibited by law, e.g. content which
promotes violence, is defamatory or infringes the personal rights and other rights of
third parties,
2) to use the Account, Alerabat.com and the Program itself or any of its elements in
a manner that does not interfere with its functioning, in particular through the use of
specific software or devices,
3) use of the Account, Alerabat.com and the Program itself or any elements
thereof in a manner consistent with generally applicable law,
the provisions of these Terms and Conditions as well as the general rules for the use
of the Internet.
8. In connection with the provision of item III. section 3.2 of this chapter of the
Regulations, the Organiser reserves the right to verify the fulfilment of the
aforementioned.

to submit a declaration that he/she is not engaged in business activity. If the
Organiser has a justified suspicion that the statement submitted is inconsistent with
the facts, the Organiser has the right to terminate the agreement in accordance with
the principles regulated in Chapter VII of these Rules.
IV. ACQUISITION OF CASHBACK POINTS
1. As part of the Cashback Programme, the Participant can acquire Points for
making purchases of goods or services from the Organiser's Partners as
indicated in the Cashback Promotion.
2. Subject to point 1 above and the other provisions of these Terms and Conditions,
in particular the provisions of Chapter VI of these Terms and Conditions, only the
Purchase of products or services specified in active Promotions presented at
Alerabat.com shall entitle to the acquisition of Points. Duration of a given
The Cashback Promotion is defined each time in the Promotion itself and depends
on the Partner offering to purchase the goods or services.
3. The information on the number of Points that a Participant can receive for making
a Purchase as defined in the Cashback Promotion is provided each time in the
description of that Promotion. The information on the number of Points may be
presented in particular as a percentage of the value of the purchase or as a fixed
number of Points awarded for a purchase, subject to further provisions in these
Terms and Conditions. Cashback Points expressed as a percentage of the value of
the Purchase price, unless explicitly indicated
otherwise in the Promotion itself, are entitled to the value of the net price of the goods
or services included in the Purchase only, without the price of delivery or additional
costs.
4. The number of Points that a Participant can receive for making a Purchase as
defined in the Cashback Promotion is determined each time by the Partner.
5. In order to receive Points, the Participant:
1) must log into their Alerabat.com Account,
2) selects the active Cashback Promotion he/she is interested in from the list
presented on Alerabat.com,
3) clicks on the link "activate cashback" which redirects from the
Cashback Promotion directly to the website or service of the relevant
Affiliate and
4) makes a purchase directly from the Partner of the product or service indicated
in the Cashback Promotion.
6. The rules for the implementation of the purchase of goods or services from a
given Partner specified in the Promotion are defined each time by the Partner
itself.
7. The Participant, when making a Purchase from a Partner, enters into an
agreement in respect of that Purchase directly with such Partner. The Organiser is
not a party to such a relationship, in particular it is not the seller of the goods or the
provider of the services ordered by the Participant.
8. When making a purchase, the Member must always familiarise themselves
directly on the Affiliate's website or service with the Affiliate's terms and conditions
for processing orders for goods and services, including, in particular, the Affiliate's
general terms and conditions of service, rules of procedure or similar documents.
9. Unless otherwise specified by the Affiliate or the Affiliate itself, the use of the
Programme as part of a given Purchase from an Affiliate cannot be combined with
discounts, promotions, loyalty programmes or similar actions organised by entities
other than the Organiser, including the Affiliate itself.
10. In order to correctly accrue Points, the Participant should also comply with
the following technical conditions, related to the necessity of linking the
Purchase of a given Participant with a Purchase under the Programme carried
out in accordance with the Promotion. Each time, the Participant should:
1) keep cookies and JavaScript enabled on the device used to access the
Programme;
2) go to the Affiliate's website or service where he/she will only make a Purchase
via the link redirecting to that website - available in the Cashback Promotion;
3) not to use any mechanism, software or other infrastructure that blocks or
prevents the redirection of the Participant from the Cashback Promotion directly to
the Affiliate's website or service or prevents the Organiser from tracking the
redirection from the link in the Promotion to the Affiliate's website or service;
4) use the messages and instructions displayed on Alerabat.com.
11. A Participant's failure to comply with the terms and conditions referred to in
section 9 above, including in particular the interruption of the redirection, for
example as a result of closing or refreshing the Partner's website, going to other
sites, using third-party software or infrastructure that interrupts the redirection, may
result in an incorrect accumulation of Points or completely
prevent their accrual, even if the Participant has fulfilled all the other conditions for
receiving Points, including making a Purchase.
12. The Organiser shall not be liable for the non-counting or incorrect counting of
Points due to Purchases made in breach of the conditions referred to in points 10-11
above. Such Purchases may, for technical reasons, not be registered by the
Organiser and are not subject to complaint.
13. Subject to the conditions for receiving Points referred to in the above provisions,
the Participant will receive Cashback Points when the following conditions are met:
1) To make a Purchase - means to correctly place an order with the Affiliate for
a good or service indicated in the Cashback Promotion, made by going directly
to the Affiliate's website or service via a link redirecting to that website or
service. The link redirecting from the Cashback Promotion to the Partner's
website or service is presented each time in the Promotion;
2) Payment for the Purchase - means that the full amount of the payment for the
product or service purchased by the Member is credited to the Partner's account
together with the costs of delivery or other costs related to the Purchase and in
accordance with the order placed with the Partner. In the event that the Member,
when making a Purchase, has chosen a method of payment other than direct
transfer to the Partner's account, including in
in particular, payment on delivery - the moment of payment shall be deemed to be
the moment when the Partner receives information that the Participant has made
payment from the operator accepting or handling payment for the Participant's
Purchase;
3) Failure by the Participant to exercise a statutory or contractual right to
withdraw from the contract or the occurrence of other cases where the purchase
of goods or services does not actually take place.
14. For the avoidance of doubt, the Organiser indicates that in order to receive
Points, the Participant must correctly fulfil all the conditions for their receipt indicated
in these Regulations, including in particular those of a technical nature in point. 9 as
well as the organisational ones in para. 11.
15. Points received by the Participant are saved and visible as a balance when the
Participant logs into the Account.
16. After the Participant has made a Purchase, the Organiser confirms with the
Partner that the Participant has correctly fulfilled the conditions for receiving
Points, including in particular the conditions referred to in para. 11 and informs the
Participant of this in the form of an attribution to his/her Points balance or an
attribution to a given Purchase.

longer than 90 days from the date of confirmation. In special situations for reasons
beyond the Organiser's control, this deadline may be extended.
17. Under the Programme, Points are awarded separately - for each correctly
completed Purchase.
18. The Participant acquires Points when the Purchase for which they are to be
attributed acquires the status "Accepted". The statuses of Purchases and Points are
visible in the Participant's Account.
19. Purchases are given the following statuses:
1) Pending" - such status is given to a Purchase for which Points have not yet
been awarded to the Participant, either because the Participant has not fulfilled all
the conditions for receiving Points referred to above or because the Partner has
not yet confirmed that the Participant has fulfilled all the organisational conditions
(point 11) for receiving Points;
2) Accepted" - the status is given to the Purchase after the Organizer receives
confirmation from the Partner that the Participant has met all the requirements.

From the moment the Purchase receives the status of "Accepted", the Points due for
this Purchase are assigned to its balance and can be used by the Participant in
accordance with the further provisions of the Rules. The Organiser points out that a
Purchase may receive the status of "Accepted" not earlier than after the expiry of the
statutory deadline for withdrawal from the Purchase agreement and, in the event that
the Partner extends the statutory deadline for withdrawal from the agreement or
introduces a contractual deadline for withdrawal from the agreement - not earlier
than after the expiry of the latest of these deadlines and the Partner's confirmation
that the Participant has not exercised his/her right to withdraw from the purchased
goods or services;
3) Rejected" - such a status is given to a purchase which previously received the
status
"Pending" and which cannot be approved and result in the award of a
Points to the Participant due to the Participant's failure to meet all the conditions of
the Programme.
20. The Participant becomes entitled to Points when the status of the Purchase for
which they are due changes to "Accepted". Only Points for a Purchase with a
status of,
"Accepted" shall be assigned to the Participant's balance and shall constitute Points
duly acquired by the Participant and may be redeemable for a Prize in accordance
with the provisions of Section VI of the Rules.
21. Points received by the Participant in the Programme are valid for 547 days from
the date on which they are allocated to the Participant's balance after the Purchase
for which they are awarded has received the status ,,Accepted", in accordance with
point. 19 above. Points may only be exchanged for a Prize in accordance with
Section V of the Terms and Conditions during their validity period. The Participant is
requested to exchange Points before their expiry date. After the expiry date
validity Points are forfeited without the possibility of reinstatement.
22. Information on the expiry date of Points for each Approved Purchase for
which they have been attributed is visible in the Participant's Account.
23. Information on the Points exchanged by the Participant for a Reward is
shown in the Participant's balance with a status of , "Paid".
24. The Participant purchases Points in the number indicated each time in the
Cashback Promotion. In the event that Points are indicated in the Promotion
as a percentage of
If the value of the Purchase is lower than or equal to the value of the Purchase, then
unless otherwise expressly indicated in the Promotion itself, Points are due on the
value of the net price of the goods or services included in the Purchase only, without
the price of delivery or additional costs. Unless otherwise indicated, Points are
entitled on the net price actually paid by the Participant for the good or service. In the
event that the Participant makes use of discount codes, promotional actions,
programmes, discounts which are connected to the Programme as part of the
Purchase, the price actually paid by the Participant shall be taken as the basis for
calculating a certain number of Points. Unless otherwise indicated, if the Participant
pays the price of a Purchase with gift cards, points acquired in loyalty or partner
programmes, vouchers and similar
mechanisms, the Participant will not be awarded Points for the Purchase. Where the
Participant only pays part of the purchase price of a good or service using such
mechanisms, Points shall only be awarded on that part of the net price of the good
or service which was paid by the Participant otherwise than using such mechanisms
- in accordance with the standard payment methods made available by the Affiliate.
V. REFER AND EARN PROGRAMME
1. The Refer & Earn Programme is aimed at Cashback Programme Participants.
Under the Refer & Earn Programme, a Participant can acquire Points for successful
participation in the Refer & Earn Programme.
2. The Participant, in order to participate in the Refer and Earn Programme,
generates a personalised referral link via the Website, which he/she makes
available himself/herself to the Invited Person(s). The Participant has the right to
make the referral link available to more than one Invited Person, and the Organiser
does not set a limit in this respect.
3. A Participant in the Refer & Earn programme will always earn Points if the
Invited Person within 30 days from the date of his/her
register on the Website, make a purchase of more than PLN 70.00 and this
transaction has been granted the status "Accepted" in accordance with
provisions of clause IV, subclause 19(2) of the Regulations ("Effective Participation").
4. An Invited Person who has registered on the Website via an individual referral
link obtained from a Cashback Programme Participant, who has made purchases of
more than PLN 70.00 within 30 days of this registration and this transaction has
been given the status "Accepted" in accordance with the provisions of point IV, item
19, paragraph 2 of the Terms and Conditions, will receive Points once. The Invited
Person, after the aforementioned registration, becomes a Participant.
5. In the Refer & Earn Programme, each participant can earn a maximum of 150
Points for Successful Participation. A participant may receive points once for each
Invited Person who successfully participates in the Refer & Earn Program.
Receiving Points once means that in the event that an Invited Person withdraws
from the Referral and Earn Program after Successful Participation (including by
deleting their account on the Platform), and they again receive an individual referral
link and Successfully Participate in the Program, the Referral and Earn Program
Points will then not be allocated to either the Participant or this Invited Person.
Furthermore, Points will not be awarded for the Successful Participation of Invited
Persons who already have a profile on AleRabat.com Services and who have
created another profile on AleRabat.com Services in order to benefit from the Refer
& Earn Program.
6. Subject to the other provisions of these Terms and Conditions, and in particular
the provisions of Chapter IV, Successful Participation in the Refer and Earn
Programme shall entitle you to acquire Points.
7. Information on the number of Points that a Participant and an Invited Person
may receive for successful participation in the Refer & Earn program is provided
in each case in the description of the Refer & Earn program. Information on the
number of Points may be presented in particular as a percentage of the
purchase price or as a fixed number of Points awarded for Successful
Participation. Points expressed as a percentage of the purchase price, unless
expressly indicated
otherwise in the Promotion itself, are entitled to the value of the net price of the goods
or services included in the Purchase only, without the price of delivery or additional
costs.
8. The allocation of points for Successful Participation is automated and
the correct process for allocating points rests with the
Organiser. The points received by the Participant and the Invited Person are recorded
and visible as a balance when the Participant logs into the Account.
VI. CASHBACK POINTS EXCHANGE
1. Within the framework of this Programme, the Participant may exchange Points
which have been credited to his/her balance as a result of the Purchase of a Status
, 'Accepted' for the Award.
2. The Participant may exchange Points for a Prize in the ratio: Point to a specific
value expressed in currency, according to the conversion rate indicated in the
Account.
3. A Participant may redeem Points when the minimum threshold of Points
attributable to Purchases which have been awarded a status of
"Approved". The number of Points which constitutes the minimum threshold for the
payment of Points referred to in the previous sentence is indicated on Alerabat.com
when you log into your Account.
4. In order to exchange Points for a Prize, the Participant shall order the
exchange of Points for a Prize and the withdrawal of the Prize using the form
available after logging in to the Account. For this purpose, the Participant will be
asked to provide the data marked as mandatory, including in particular the bank
account number belonging to him/her, to which
The Organiser is to transfer the Prize and, in the event that the Participant orders a
payment using an external payment intermediary service, the Participant is asked
to select this system from those available at Alerabat.com.
5. The Organiser shall pay the Prize by transferring the funds to the Participant's
nominated bank account or transferring them using an external payment
intermediary service, within a maximum of 7 (seven) working days (i.e. excluding
Saturdays, Sundays, public holidays and public holidays).
6. The time when the Prize is awarded to the Participant is deemed to be the
time when the funds are transferred for payment.
7. Each time a payment is made, the value of the Award made is the value of the
single Award granted.
8. In the event that a Participant wishes to exchange Points for a Prize and to
withdraw the Prize, the Participant may only exchange and withdraw all the Points
held in his/her balance, subject to the other provisions of the Terms and Conditions.
The Participant does not have
only part of the Points can be exchanged and replaced.
9. The Participant may only use the Points he/she has received to exchange
them for a Prize in the form of cash, in accordance with the rules above.
10. The Participant cannot transfer the Points he/she has received to other persons.
11. The Organiser may refuse to exchange the Points for the Reward and its
payment to the Participant, as well as cancel the Points which have already been
credited to the Participant's balance for important reasons, which are understood to
be a justified suspicion of a breach by the Participant of common law, including in
particular in the case of an attempt to commit an act prohibited by law using the
Programme, Alerabat.com or their elements, an attempt by the Participant to
circumvent the mechanisms and rules of the Programme, as well as doubts of the
Organiser as to the identity of a given Participant or the data provided by him/her.
12. The prize paid to the Participant, the one-time amount of which does not exceed
the amount of PLN 2,000, is exempt from taxation pursuant to Article 21 (1) para. 68
of the Personal Income Tax Act of 26 July 1991, provided that the Participant does
not receive these funds in connection with his/her business activity.
13. If the value of the Prize granted to a Participant at one time exceeds the amount
of
PLN 2,000, the Organiser shall, on the basis of the relevant provisions of the Personal
Income Tax Act of 26 July 1991, pay the Participant the Prize less the income tax due
on the Prize awarded.
14. By accepting these Terms and Conditions, the Participant confirms and declares
that his/her participation in the Cashback Programme and purchases made under
the Programme are not connected with his/her business activity. By doing so, he/she
confirms that the Cashback Programme Organiser is entitled to apply the tax
exemption under Article 21(1)(68) of the Personal Income Tax Act of 26 July 1991 to
the prizes issued to him/her. The Participant also confirms that by providing
untruthful information, he accepts liability.

collect lump-sum income tax on competition winnings.
VII. TERMINATION OF PARTICIPATION IN THE PROGRAMME
1. The Participant may terminate the participation agreement in the Programme at
any time with immediate effect by submitting a statement in writing to the registered
address of the Organiser or by e-mail to: [email protected].
2. The cancellation of the Alerabat.com account is tantamount to a termination of the
contract.
Participation in the Programme by the Participant referred to in point. 1.
3. For valid reasons, the Organiser may terminate the contract of the Participant with
14 days' notice. The valid reasons referred to in the preceding sentence shall be
deemed to be:
1) breach of the Rules by the Participant,
2) breach by the Participant of applicable laws in connection with the
Programme,
3) taking any action by the Participant that constitutes an attempt to
circumvent the Rules or the security and operation of the Programme.
4. In the event of termination, the Organiser shall indicate to the Participant
the reasons for the termination.
5. Termination of participation in the Programme (including both termination by the
Participant himself, as referred to in para. 1 and 2, as well as termination by the
Organiser for the reasons indicated in para. 3 above leads to the loss of the
possibility to exchange Points for a Prize.
6. A Participant who intends to terminate his/her participation in the Programme
should, if possible, exchange his/her accrued Points for a Reward and payout in
advance, in accordance with the rules set out in these Rules. If the Participant
terminates the agreement without first exchanging the Points for a Reward and their
withdrawal, the unused Points are erased - they are forfeited without the possibility
of reinstatement.
7. In the event of termination of the Agreement by the Organiser in accordance with
para. 3 above, the Participant is requested to exchange his/her accrued Points for
the Prize and pay out within the notice period referred to in point. If the Participant
does not redeem the Points for the Prize and its payment within the notice period,
the unused Points will be erased - forfeited without
the possibility of restoring them.
8. In the event that the Organiser terminates the Participant's Agreement in the
manner referred to in para. 3 above, during the period of termination, the
Participant's Account and participation in the Programme shall remain suspended,
which means that the Participant will not receive new Points for Purchases made
from the date of termination.
9. The Organiser may terminate the Programme. Participants will be notified of
such a decision no later than 30 days in advance. During this time, Participants can
exchange Points for a Prize and its payment, in accordance with the
Regulations. At the end of the Programme, any Points not used by the Participant will
be erased - they are forfeited without the possibility of reinstatement.
10. The Participant may withdraw from the agreement to participate in the
Programme without stating a reason by submitting an appropriate declaration
within 14 days from the date of concluding the agreement (joining the
Programme). Sending the declaration before the deadline is sufficient to meet
this deadline.
11. The 14-day period counts from the date of conclusion of the contract.
12. Upon receipt of the Participant's statement of withdrawal, the Organiser will
send an acknowledgement of receipt of the statement of withdrawal to the

13. The Participant's right of withdrawal is excluded in the case of the provision of
a service, if the Organiser has performed the service in full with the express
consent of the consumer, who has been informed prior to the provision of the
service that he/she will lose the right of withdrawal after the performance.
VIII. COMPLAINTS AND OUT-OF-COURT DISPUTE RESOLUTION
1. Complaints regarding the Programme can be submitted to the Organiser in
writing to: 24 Fabryczna Street, Katowice (40-611), by e-mail to:
[email protected] or by using the contact form available at Alerabat.com.
2. Complaints regarding the award and exchange of Points for a Reward under the
Programme may be made within 90 (ninety) days from the date of the transaction
entitling them to be awarded or from the date of the order for the exchange of Points
for a Reward and its payment, respectively.
3. The complaint should include: name, surname, address of the entity making
the complaint, telephone number and e-mail address, as well as a detailed
description and reason for the complaint.
4. The Organiser can request from the person submitting the complaint all the
information required for the proper investigation of the complaint as well as the
documents confirming the transaction which entitles the holder to the award of
Points, i.e. in particular: the confirmation of purchase, the confirmation of order
placement, the invoice with the visible date of sale or provision of the service, the
amount to be paid, the order number and the type of goods or services ordered.
Failure by the complainant to provide the requested information and documents
entitles the Organiser to disregard the complaint.
5. The Organiser will consider the complaint immediately, but no later than
within 30 (thirty) days of receipt.
6. The Organiser will inform the complainant of the consideration of the complaint
within the aforementioned time limit in writing or by e-mail to the address provided
in the complaint application.
7. The Participant may make use of out-of-court means of handling complaints and
pursuing claims in accordance with the rules set out at www.uokik.gov.pl under
"Resolution of consumer disputes". In particular, the Participant may:
1) obtain free assistance in resolving any dispute between the Participant and the
Organiser with the assistance of the county (municipal) ombudsman
consumers or a social organisation whose statutory tasks include consumer
protection (e.g. Federation of Consumers, Association of
Polish Consumers Association). Advice is provided by the Federation of Consumers
under the toll-free Consumer Helpline number 800 007 707 and by the Association
of Polish Consumers under the email address
[email protected];
2) submit your complaint via the EU ODR online platform, available at:
http://ec.europa.eu/consumers/odr/
IX. PROTECTION OF PERSONAL DATA
The Organiser shall process Participants' personal data in accordance with applicable
law and in accordance with the Privacy Policy.
X. FINAL PROVISIONS
1. Information on the Programme will be communicated to Participants by means of
messages on the alerabat.com website or sent by post, in the form of an email to the
email address provided by the Participant in the Account.
2. In the event of changes to the Terms and Conditions, the Participant will be
informed of any changes to the Terms and Conditions through information on the
Website listing the changes and their effective date. The effective date of the
changes will be no shorter than 14 days from the date of their announcement. If the
Participant does not accept the new content of the Rules and Regulations, he/she
is obliged to notify the Organiser of this fact within 14 days from the date of
informing about the change of the Rules and Regulations. Notifying the Organiser
of the lack of acceptance of the new content of the Rules shall result in the
termination of the participation agreement in the Programme. In such a case, the
Participant is obliged to exchange his/her Points for the Prize and its payment.

If the Participant does not redeem the Points for the Prize and its payment within the
time limit referred to in the previous sentence, the unused Points are deleted - they
are forfeited without the possibility of reinstatement.
3. In the event that the Organiser makes the Programme available for a country also
in other of its products, including in particular the Application, the Plug-in, other
software or infrastructure, information about changes to the Terms and Conditions
may also be communicated in or through these products.
4. Unless otherwise stipulated by mandatory provisions of law, Polish law shall
govern all disputes arising from these Terms and Conditions.
5. In the event that the mandatory provisions of the law of the country of habitual
residence of the Participant or other regulations applicable to the Consumer provide
for more favourable conditions for the Consumer than the provisions of Polish law
and the provisions of these Terms and Conditions, the provisions more favourable
for the Consumer shall apply.
6. Unless otherwise stipulated by mandatory provisions of law, the
settlement of any disputes arising between the Organiser and the
Participant shall be submitted to the competent Polish courts.
